01Introduction
These Terms of Service (the “Terms”) are a binding legal agreement between you (the “User”, “you”) and SocialBoiler (“SocialBoiler”, “we”, “us”, “our”). They govern your access to and use of our website at socialboiler.app and the SocialBoiler application (together, the “Service”).
By creating an account, clicking a button marked “I agree” or similar, or otherwise using the Service, you confirm that you have read, understood and accept these Terms and our Privacy Policy, Acceptable Use Policy, and Cookie Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you personally and that organization.
02Description of the Service
SocialBoiler is an AI-powered short-video automation platform. It helps creators discover trending topics, generate scripts, voiceovers and 9:16 video using third-party AI providers, review the output, and — at the User's direction — publish that content to connected social-media platforms including YouTube, Instagram, TikTok, Facebook, LinkedIn and X.
The Service is provided on a continuously evolving basis. We may add, modify, suspend or remove features at any time, and we may set reasonable usage limits to maintain reliability and fairness for all users. We will give reasonable advance notice for material changes that affect paying customers.
03Eligibility
To use the Service, you must:
- Be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher;
- Have the legal capacity to enter into a binding contract under the laws of your country of residence;
- Not be barred from receiving services under the laws of the United States or any other applicable jurisdiction; and
- Comply at all times with these Terms and all applicable laws.
04Your account
You must create an account to use most features of the Service. You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at security@socialboiler.app if you suspect unauthorized access to your account. We are not liable for losses arising from your failure to safeguard your credentials.
You may not transfer or share your account, sell, lease or otherwise assign your access rights to anyone else. We reserve the right to require additional verification, including phone or identity verification, where reasonable to protect the Service.
05Acceptable use
Your use of the Service is also governed by our Acceptable Use Policy. In summary, you agree not to use the Service to:
- Create or publish content that is unlawful, defamatory, hateful, harassing, sexually exploitative of minors, deceptive, infringing, or otherwise harmful;
- Impersonate any person or misrepresent your affiliation with any person or organization;
- Generate or distribute spam, malware, misinformation, deepfakes without consent, or content that violates the policies of any connected platform;
- Infringe the intellectual-property, privacy, publicity or other rights of any third party;
- Reverse-engineer, decompile, scrape, disrupt, overload, probe or attempt to gain unauthorized access to the Service, its underlying systems or other users' data;
- Use the Service to compete with us, including by training a competing AI model on our outputs or scraping our interface;
- Resell, rebrand, sublicense, or grant access to the Service to any third party without our prior written consent.
We may, at our sole discretion, investigate suspected violations and suspend or terminate accounts that violate these Terms or our policies, with or without notice.
06Your content and license to us
You retain all ownership and intellectual-property rights in the content you upload, input or create through the Service (your “User Content”), subject to the rights we hold in the Service itself and in any AI-model outputs as described below.
You grant SocialBoiler a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, transmit and process your User Content solely for the purpose of operating, maintaining and improving the Service for you — including generating videos, transmitting them to your connected platforms when you publish, and providing backups and security.
You represent and warrant that (a) you own or have all necessary rights to your User Content; (b) your User Content does not violate these Terms or any law; and (c) publishing your User Content via the Service does not infringe any third-party rights. You are solely responsible for your User Content and for any consequences arising from publishing it.
07AI-generated content
The Service uses artificial-intelligence models — including large-language-model script generation, text-to-speech voice synthesis, and text-to-video clip generation — provided by third parties such as OpenAI, Google Gemini, Lightricks (LTX), Groq and others. We may change AI providers at any time.
AI output (each, an “Output”) is generated probabilistically. It can be inaccurate, fabricated, biased, offensive or substantially similar to existing works, and is provided without any warranty of originality, factual accuracy, suitability or non-infringement. Two different users prompting the Service in similar ways may receive similar or identical Outputs; we make no claim of exclusivity in any Output.
To the maximum extent permitted by law and the terms of our AI providers, you may use Outputs you have generated for any lawful purpose, including commercial use. You assume sole responsibility for reviewing every Output before publishing it, ensuring it meets your standards, complies with all applicable laws and platform rules, and does not infringe any third-party right. The Service is designed with a review step for exactly this reason.
08Third-party platforms and services
The Service integrates with third-party social platforms (YouTube, Instagram, TikTok, Facebook, LinkedIn, X) and other third-party services (including AI providers, the Upload-Post publishing aggregator, json2video for rendering, Supabase for storage, and n8n for automation). Your use of those third parties is governed by their own terms and privacy policies.
We are not responsible for the availability, decisions, fees, content moderation or other actions of any third-party platform — including the removal of your content, the suspension or termination of your accounts on those platforms, or the rate limits, account-type requirements and other restrictions they impose (for example, Instagram's requirement of a Business or Creator account for API publishing).
09Plans, billing and refunds
The Service is currently free to start. We may introduce paid plans and usage-based pricing for higher tiers, increased quotas, additional AI generation credits, or premium features. The current plan, its features and price will be clearly displayed before you purchase.
If you purchase a paid plan, you authorize SocialBoiler and our payment processor to charge the applicable fees and any applicable taxes to your chosen payment method on a recurring basis, in advance of each billing period, until you cancel. Cancellation takes effect at the end of the then-current billing period. Fees are non-refundable except where required by applicable law or as otherwise stated in our Refund Policy.
Certain features depend on third-party AI services that carry per-usage costs (for example, video generation via LTX). If we ever pass through such costs, the rates will be made clear in your account before they are incurred.
We may change pricing at any time. For users on a recurring plan, we will give at least 30 days' notice before a price change takes effect on your next renewal, and you may cancel before the change becomes effective.
10Intellectual property in the Service
The Service itself — including all software, source code, user interface, design, graphics, audio, branding, the “SocialBoiler” name, the loop mark logo, copy, documentation, and any improvements and derivative works thereof — is owned by SocialBoiler and our licensors and is protected by United States and international copyright, trademark, patent, trade secret and other laws.
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms during the term of your account. No other rights are granted. You may not remove or alter any proprietary notice on the Service, or use our trademarks without our prior written consent.
We respect intellectual-property rights and respond to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act — see our DMCA Policy.
11Feedback
If you send us suggestions, ideas, enhancement requests, feedback or other input about the Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use the Feedback for any purpose, without any obligation or compensation to you. We are not required to keep Feedback confidential.
12Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. To the maximum extent permitted by applicable law, SocialBoiler disclaims all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and quiet enjoyment.
We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that defects will be corrected; that the Service will produce specific results (including any social-media performance, engagement, view counts or revenue); that any AI Output will be accurate, complete, original, non-infringing or fit for any particular use; or that the Service will comply with any specific third-party platform's requirements at any given time.
13Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOCIALBOILER, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OPPORTUNITY OR OTHER INTANGIBLE LOSSES arising out of or related to these Terms or your use of the Service, even if we have been advised of the possibility of such damages.
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.
14Indemnification
You agree to defend, indemnify and hold harmless SocialBoilerand its officers, employees, agents and affiliates from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your User Content, including any Output you publish; (b) your use of, or inability to use, the Service; (c) your violation of these Terms, our policies, or any third-party right (including any intellectual-property, privacy, or publicity right); or (d) your violation of any law or regulation.
15Termination
You may terminate these Terms at any time by deleting your account from your account settings or by contacting support@socialboiler.app.
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause and with or without notice, if (a) you violate these Terms or our policies; (b) we are required to do so by law, court order or governmental request; (c) your account creates a security or stability risk to the Service or other users; or (d) we discontinue the Service or a feature.
On termination, your right to use the Service ends. We may delete your data after termination subject to our retention practices in the Privacy Policy. Sections that by their nature should survive termination (including ownership, indemnification, disclaimers, liability limits, governing law and dispute resolution) will continue to apply.
16Modifications to these Terms
We may amend these Terms from time to time. When the amendments are material, we will update the “Last updated” date and provide notice to you — for example, by posting a notice in the application or sending you an email. Your continued use of the Service after the effective date of the amended Terms constitutes acceptance. If you do not agree with the changes, you must stop using the Service before the changes take effect.
17Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The federal and state courts located in the county of our registered office, California have exclusive jurisdiction over any dispute not subject to arbitration under the next section.
18Arbitration and class-action waiver
Please read this section carefully — it affects your legal rights.
Except for claims of intellectual-property infringement or claims that may be brought in small-claims court, you and SocialBoiler agree to resolve all disputes through binding individual arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures, conducted in the United States. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
CLASS-ACTION WAIVER. YOU AND SOCIALBOILER AGREE TO BRING ANY DISPUTE ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.
You may opt out of this arbitration agreement by sending written notice to legal@socialboiler.app within 30 days of first accepting these Terms; your notice must include your full name, mailing address and a clear statement that you wish to opt out.
19Export, sanctions and government use
You agree to comply with all applicable export-control and sanctions laws, including those of the United States. You represent that you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive US sanctions, and that you are not on any US government list of restricted persons. The Service is a “commercial item” as defined in 48 C.F.R. § 2.101 and US Government use is subject to these Terms.
20Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy, Acceptable Use Policy, Cookie Policy, DMCA Policy and Refund Policy, constitute the entire agreement between you and SocialBoiler regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely, including to a successor in connection with a merger, acquisition or sale of assets.
No agency. No agency, partnership, joint venture or employment relationship is created by these Terms.
