01Overview

SocialBoiler respects the intellectual-property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement under the United States Digital Millennium Copyright Act (the “DMCA”), 17 U.S.C. § 512, and to equivalent processes in other jurisdictions where appropriate.

03How to file a takedown notice

To be effective under the DMCA, your written notice must include substantially the following information:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved;
  • Identification of the material that is claimed to be infringing, with enough detail to enable us to locate it — typically the URL on the platform where the content was published and the SocialBoiler account or video id if known;
  • Your contact information — full name, mailing address, phone number and email;
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law;
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Send the completed notice to the agent above. Incomplete notices may not be actionable.

04What we do when we receive a notice

If we determine that a notice is valid under the DMCA, we will:

  • Remove or disable access to the allegedly infringing material stored within SocialBoiler;
  • Forward the notice (including your name and email) to the affected user and let them know what was removed and why;
  • Track repeated incidents and, in line with the DMCA repeat- infringer policy, terminate the accounts of users who infringe repeatedly.

We may also contact connected social platforms in our control to assist with takedowns where appropriate, although removal of content already published to third-party platforms is governed by those platforms' own processes.

05Counter-notice

If your content has been removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may file a counter-notice with our agent. To be effective, your counter-notice must include substantially the following:

  • Your physical or electronic signature;
  • Identification of the material that has been removed and the location at which it appeared before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your full name, mailing address, phone number and email;
  • A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located (or, if outside the United States, in the county of our registered office, California), and that you will accept service of process from the person who provided the original notice or their agent.

On receipt of an effective counter-notice we may restore the material as permitted by 17 U.S.C. § 512(g), unless the original claimant notifies us that they have filed a court action.

06False claims warning

Under 17 U.S.C. § 512(f), any person who knowingly makes a material misrepresentation in a takedown notice or counter-notice may be liable for damages, including costs and attorneys' fees. Please consult an attorney if you are unsure whether your use of someone else's material is lawful.

07Repeat-infringer policy

In accordance with the DMCA and other applicable laws, we will terminate the accounts of users determined to be repeat infringers in appropriate circumstances. We may also restrict access in any case where we believe a user is infringing the rights of others.
